Abstract

The Republic of Serbia's positive criminal procedural law foresees three types of agreements that can be concluded between the public prosecutor and the defendant: an agreement on the recognition of a criminal offense, an agreement on the testimony of the accused, and an agreement on the testimony of a convicted person. The "agreement on costs of criminal proceedings" is an obligatory component of those agreements, with the exception of the agreement on the testimony of the convicted. In the paper, the author pointed out certain legislative omissions, namely the necessity for clarification and more sufficient legislative and technical formulation of the corresponding Criminal Procedure Code sections.
